This Modern Love is a handmade bridal design business selling made to order and bespoke bridal gowns, bridesmaid dresses, ready to wear garments and made to order bridal lingerie kimonos and veils and other bridal accessories. Made to order and bespoke garments are created based on the measurements provided by the Customer. The style of the dresses are relaxed, non structured, and pull on designs. This Modern Love will deal with the customer's order in accordance with our obligations under the Sale of Goods Act 1979 (as amended) and the Sale and Supply of Goods to Consumer Regulations 2002.
"Customer" means any person who is purchasing from the Supplier.
"Supplier" means This Modern Love.
“Made to order” - existing design of style of dress made specific to your measurements and preferred length
“Bespoke” - composite of existing designs made specific to your measurements and preferred length
“Ready to wear” - ready made, limited edition garments, also known as ‘sample sale’ pieces
If the Customer is not satisfied with the quality of the ordered dress(es), This Modern Love will, after inspection of the goods, follow a strict policy of Repair or Replace depending on which remedy is the most appropriate.
This Modern Love retains ultimate discretion on whether a product is deemed faulty or not.
Dresses are made to order and individually cut for the Customer and therefore none are returnable or refundable, save in the circumstances whereupon the Supplier deems that it is a faulty item. This Modern Love can accept no responsibility for the wrong order being made and it is therefore imperative that the Customer checks the details of the order prior to ordering.
Title in the Goods shall not pass until the price of the dress(es) has been paid in full for the Goods.
The Supplier warrants that the garments' description will correspond with the description logged by the customer at the time of purchase.
The supplier shall ensure that all dresses supplied to the Customer are made in accordance with the measurements provided by the Customer at the time of purchase.
The Supplier shall not be liable for any loss or cancellation of order relating to a change in the dimensions after the order was placed.
To enable the Supplier to perform the contractual terms and produce the dress, the Customer must co-operate with the supplier by providing the supplier with their measurements.
If the information relating to the requested size of the garment proves to be erroneous,
If the Customer changes or wants to alter the size of the garment after placing an order, the following shall occur:
The Supplier will not be liable for any additional expenses incurred in altering the garment.
The Customer shall be liable for all costs related to re-ordering the dress(es) if they need to be re-made due to a change to the previously recorded measurements.
Risk of loss
All purchases made at Supplier, are made pursuant to a shipping contract. By purchasing from the Supplier, the Customer agrees that the title to and risk of loss for such items passes to themselves upon delivery of the items.
Terms and conditions of order placement, order changes and returns
Use of this website and the online shop implies that all the terms and conditions in regard to order placement and other issues concerning orders, as outlined here have been accepted and agreed to.
It is understood that an order, once it has been submitted and subsequently processed cannot be cancelled. Should it under some circumstances, be agreed by the Supplier to cancel an order, cancellation charges of £40 would be deducted from the submitted payment before a refund is issued.
Any changes must be made to an order within 24 hours of placing an order; making a change within 24 hours of placing the order does not guarantee that a change can be made. The Supplier will, where possible, endeavour to make change.
As each dress is made to order, the Supplier is unable to resell an order to any Customer other than the Customer placing the order, and as such the Supplier cannot accept returns on the basis of a change of heart on the part of the Customer. Neither can the Supplier accept returns where the Customer requests a change to an existing order and the Supplier cannot fulfil that change. Where there is a dispute between Customer and Supplier over the styling of the order, the record on the Supplier's ordering system is taken as the firm and final order.
Terms & Conditions Of Deadlines And Deliveries
It is understood that turnaround and dispatch of the orders placed at the Supplier may vary from time to time depending on current order volumes, work schedules, fabric availability or a particular characteristic of the order placed. For Ready to Wear and Made to Order Kimonos, the Supplier will try its best to comply with the average turnaround of 2 weeks from payment. For made to order and bespoke bridal gowns the Supplier will endeavour to meet the average turnaround time of 12 weeks from payment.
Dispatch times may vary according to availability, any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure (including Acts of God, Acts of War or Acts of Terrorism) for which the Supplier will not be responsible. The Supplier will not be responsible for such delays resulting from situations within the recipient's control, such as recipient not being available to accept delivery, or incorrect delivery details supplied.
A delay does not include any alterations that are requested by the Customer.
For made to order and bespoke dresses, the garment will be made to the measurements provided by the customer.Please bear in mind that the dresses are a simple pull on style without zips or fastenings. They pull on over the head and cinch in at the waist with elastic. This creates an overall relaxed fit which is the style of the dress. It is customary that the Customer may require additional fittings with a local seamstress or tailor to ensure the perfect fit, which you may wish to undertake with a local dressmaker.
Once cut, the dresses cannot be made any bigger or any longer, nor the style of the dress changed, therefore the Customer must consider this prior to placing an order.
The Supplier will endeavour to ensure that the Customer is satisfied with the fit and quality of the made to order or bespoke dress - should there be an issue with the quality of the made to order or bespoke dress the Customer must notify the Supplier within three days of receipt whereupon the Supplier will endeavour to find a satisfactory solution for both parties. As all items are handmade to order the dress is made especially for each Customer and as such are not returnable or refundable.
The Supplier follows a strict repair/alter, replace, refund policy. The supplier retains ultimate discretion on whether a product is deemed faulty or not.
Alterations to made to order kimonos
A complimentary fitting (alteration) is included with all made to order kimonos, on the proviso that the kimono can only be made shorter or smaller ("taken in") to improve fit. Fittings (alterations) must be requested within 14 days of receipt of the garment.
The Customer is required to pay the postage cost to return the garment to the Supplier, and the Supplier will then pay the additional postage cost to return the dress to the Customer after the fitting (alteration) has been carried out.
It is not possible to alter the garment to make it bigger or longer. Such alterations will require the Customer to re-order the kimono. The Supplier accepts no liability for erroneous measurements provided when placing an order. Customers are advised to contact the Supplier to seek clarification on how to measure prior to placing an order.
Colours and Samples
Please note that the Supplier does not hold stocks of fabric. Fabrics are purchased from a third party when the Customer places an order.
Due to the possible inconsistencies of various display monitors, the colours you see on your screen may not be a 100% accurate representation of the fabric.
The Supplier recommends that all orders for one bridal party are ordered at the same time to avoid different rolls of fabric being used or any colour or fabric being discontinued, neither of which the supplier will be liable for.
Customers are advised to visit the ‘This Modern Love’ studio to view the fabric sample books in person prior to ordering to avoid disappointment.
Ready to Wear Dresses
In accordance with the Sale of Goods Act 1979 (as amended) and the Sale and Supply of Goods to Consumer Regulations 2002, This Modern Love Ready to Wear dresses (also known as 'one off'/'sample' dresses are refundable on the basis that these have not been made to order.
Fittings and alterations are not included on Ready to Wear dresses - the Customer may choose to have the garment altered with a local seasmstress, tailor or dressmaker at their own expense. Any alterations or changes to the garment will render it non returnable. On receipt of the dress the Customer has seven days in which to return the dress to the Supplier. It must be returned unworn and in the good condition in which it was received. The Customer is entitled to a refund of the cost of the dress, however the postage costs to return the dress to the Supplier are at the Customer's expense. It is the Customer's responsibility to notify the Supplier within the strict seven day timeframe that they wish to request a refund - the Customer should contact the Supplier via email at firstname.lastname@example.org or via the conversation tool on Etsy.
In exceptional circumstances, if a Ready to Wear dress is altered by the Supplier, (at additional cost) at the Customer's request, to meet their requirements then the dress is then classed as a bespoke or made to order dress, and cannot be returned for a refund.
